Bitcoin Mining Company NewRays Sues Judge and Prosecutor Over Alleged Targeted Enforcement

Bitcoin Mining firm NewRays has taken Legal action against a judge and prosecutor, accusing them of selectively enforcing noise legislation against the company. The complaint, filed on September 26, alleges that despite other companies producing more noise, laws were specifically crafted to target NewRays.

NewRays established a Data center for crypto Mining in Arkansas before local noise ordinances were implemented. The company believes these ordinances were designed to unfairly single them out.

In the lawsuit, NewRays claims that Judge Allen Dodson, prosecuting attorney Phil Murphy, and other defendants unfairly targeted the company with noise legislation. The company states that the noise ordinances were created solely to apply to NewRays, despite other entities generating more sound.

Community Impact and Legal Actions

Neighboring residents have complained about the noise generated by NewRays, which has led to failed attempts to sell nearby land and decreased property values. In an effort to address the issue, the company installed sound barriers at the request of a neighbor, but these measures did not fully resolve the noise concerns.

Similarly, in Texas, cryptocurrency miner Marathon Digital faced noise complaints from residents, resulting in multiple charges against the company's site manager. Local residents reported health issues, such as headaches and sleep disturbances, attributed to the constant noise generated by the Mining operation. Despite the charges, the site manager was acquitted of all noise violations.

In response to the situation, the Faulkner County Quorum Court in Arkansas attempted to introduce a law specifically targeting crypto Mining operations. However, due to inadequate attendance at the meeting, the proposal was ultimately dismissed.

Insights and Industry Response

Justin Daniels, a co-chair of a leading law firm's blockchain and Digital assets practice, expressed that selective enforcement against cryptocurrencies due to their reputation is not surprising. He noted that while Bitcoin Mining faces criticism for its energy consumption, other industries, like artificial intelligence Data centers, operate similarly without receiving the same level of scrutiny. Daniels highlighted the differing perceptions of value between Bitcoin and AI as a contributing factor to the criticism.

The ongoing Legal battle between NewRays and the local authorities underscores the challenges faced by cryptocurrency companies in navigating regulatory environments and community relations.

Conclusion and Call to Action

As the dispute continues, it is essential for all parties involved to seek a fair and equitable resolution that balances the interests of both the company and the community. Stay updated on this developing story and other crypto-related news by subscribing to our Daily Debrief newsletter.
